Objective:

This course will enable students to know the Patent Act of India, learn Patent reports and draft specification, study some IPR Case studies and gain traditional knowledge

Course Outcomes:

CO1: Understand the knowledge on patent and traditional knowledge and their implications in research and product development;

CO2: Understand Indian system on patent and traditional knowledge

CO3: Understand Indian system of patent drafting

CO4: Understand various case studies on patent and traditional knowledge

CO5: Understand the concept of bio-prospecting and bio-piracy

CO6: Contribute effectively in course-specific interaction

Unit I:

The Patent Act of India – I

Applications for patents, publication & examination of applications, opposition proceeding to grant of patents, anticipation, grant of patents and rights conferred thereby, register of patents, patent office and its establishment, power of controller

The Patent Act of India – II

Working of patents, compulsory licenses and revocation, use of inventions for purposes of government and acquisition of inventions by central government, suit concerning infringement of patents, IPAB, penalties, patent agents, international arrangements

Patent reports and Drafting specification

Prior-at search, sources of patent and non-patent literature, types of patent specification, parts of patent specification

Case studies

Patent litigations case studies including infringement cases, compulsory license cases

Unit V:

Traditional knowledge

studies – Haldi, Neem, Basmati etc, TKDL and its impact, recent updates in the field of Traditional knowledge world- wide
